This article aims to provide historical and legal elements regarding the correlation between education, the environment, and law. It seeks to present foundations in national and international legislation to which Brazil is a signatory. Since 1934, the National Constitutions have placed the environment under the authority of the Union, both to protect and exploit it. The 1988 Constitution advanced the defense of the environment by classifying it as a "common good." This spirit and letter of the Constitution were reflected in regulations of the National Education Council and guidelines from the Ministry of Education. The current draft National Education Plan includes a chapter on this subject. The article contributes references to authors who support the defense of the environment as a right of current and future generations.
