Abstract

The aim of this study consists of analyzing the contributions of Pierre Rosanvallon’s reflexive democractic theory to Judicial Review on XXI century. The analytical corpus was defined, primarily, in the work “Democratic legitimacy” by Pierre Rosanvallon, in which the author discusses three forms of democratic legitimacy: impartiality legitimacy, reflexive legitimacy and proximity legitimacy. The essay focus is the second legitimacy. Other author texts, as well as by other academics that dialogue with the discussed book, were analyzed. The objective is, therefore, to study democracy from the reflexive legitimacy in a first approach to the topic, to delimit it in a second approach to judicial review. Furthermore, Pierre Rosanvallon’s professional and academic career will be briefly presented in order to contextualize reader about the circumstances of his thought production and insertion. The research technique used was bibliographic review.
